Service status: FotoPost is currently in development and is not yet generally available for ordering. These terms apply to orders placed once the service goes live and to any test or pilot orders.
These terms govern all orders placed through the FotoPost mobile application. By placing an order, you agree to these terms. Where your country of residence grants you stronger consumer rights under mandatory local law, those rights always prevail and are not affected by anything in this document.
FotoPost sells physical photo prints, 10×15 cm, produced on photographic paper. Prints are sold in fixed packs. All prices are total prices: they include VAT and they include delivery. No separate shipping charge, handling fee or surcharge is added at checkout.

The currency shown to you depends on your delivery country. The price you see on the confirmation screen before you pay is the price you pay. Where VAT is due, it is contained within the displayed price and is shown on your invoice; we bear any difference between national VAT rates, so the displayed price does not change with your country's VAT rate. Prices may change for future orders but never for an order already confirmed.
The contract is concluded when you confirm your photo selection and delivery address, expressly accept these terms, and payment is successfully completed.
You will receive an in-app confirmation and, in addition, a confirmation by email on a durable medium containing your order details and these terms, in accordance with Article 8(7) of Directive 2011/83/EU. If you have not received the email confirmation within 24 hours, contact us.
Payments are processed by Stripe, Inc. and its EU affiliates. We accept major credit and debit cards and the payment methods shown at checkout. We never see or store your full card details.
Prints are produced and dispatched by our print partner Familink SAS (France) and carried by La Poste and its partner carriers.
Delivery times are estimates, not guaranteed dates. Risk of loss or damage passes to you when you, or a carrier you appointed yourself, take physical possession of the goods.
You keep all rights in your photos. You grant us only a limited, non-exclusive, worldwide, royalty-free licence to store, transmit, reproduce and print the photos you select, and to pass them to our print partner and carrier, solely in order to fulfil your order. This licence ends when the photos are deleted (within 30 days of order placement — see the Privacy Policy). We never use your photos for marketing, model training, or any other purpose.
By placing an order you confirm that:
Prohibited content. You may not submit for printing any material that is unlawful, including child sexual abuse material, content that incites violence or hatred, or reproductions that are illegal to make (for example banknotes or identity documents). We may refuse or cancel any order that appears to breach this clause and will refund it. Suspected child sexual abuse material will be reported to the competent law-enforcement authorities and the account will be terminated.
You agree to indemnify us against third-party claims arising from images you submit in breach of this section.
Photo prints are goods made to your specification. Under Article 16(c) of Directive 2011/83/EU (in Poland: art. 38 pkt 3 of the Consumer Rights Act of 30 May 2014), the 14-day right of withdrawal does not apply to goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer.
Because this exclusion removes a right you would otherwise have, we draw it to your attention before you pay. By completing payment you expressly acknowledge that your prints are made to your specification and that you therefore have no 14-day right of withdrawal, and you request that production begins immediately.
If you notice a mistake, contact us at once at contact@crocodata.net. If production has not yet started, we will cancel and refund the order as a goodwill measure.
This exclusion does not affect your rights if the prints are faulty, damaged, wrong or otherwise not as ordered — see section 9.
You benefit from the statutory guarantee of conformity under Directive (EU) 2019/771 — normally two years from delivery, and longer where your national law provides. If prints are defective, damaged, or do not conform to your order, you are entitled to repair or replacement (reprint) and, where appropriate, a price reduction or refund.
Our Refund Policy asks you to report problems within 14 days so we can resolve them quickly. That 14-day period is a service commitment, not a limitation period. Your statutory rights remain available for the full statutory period regardless of when you report the problem.
Except as stated below, our liability for any single order is limited to the value of that order, and we are not liable for indirect or consequential loss.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for intent or gross negligence, for breach of essential contractual obligations, for defective products under applicable product-liability law, or for anything else that cannot lawfully be excluded. Your statutory consumer rights are unaffected.
Please contact us first at contact@crocodata.net. We acknowledge complaints within 3 business days and aim to resolve them within 14 days.

These terms are governed by Polish law. This choice of law does not deprive a consumer of the protection of mandatory provisions of the law of their country of habitual residence (Article 6 of Regulation (EC) No 593/2008, Rome I).
We may update these terms for future orders. Material changes will be notified in the app and by email where we hold your address. The version in force at the time of your order continues to apply to that order.

Diese AGB gelten für alle Bestellungen über die FotoPost-App. Mit der Bestellung stimmen Sie diesen Bedingungen zu. Zwingende Verbraucherschutzvorschriften Ihres Wohnsitzlandes gehen diesen AGB stets vor — insbesondere das deutsche Verbraucherrecht (BGB).
FotoPost verkauft Fotoabzüge im Format 10×15 cm in festen Paketen. Alle Preise sind Gesamtpreise: inklusive Umsatzsteuer und inklusive Versand. Es fallen keine gesonderten Versand- oder Bearbeitungskosten an.

Die angezeigte Währung richtet sich nach Ihrem Lieferland. Der auf der Bestätigungsseite angezeigte Preis ist der zu zahlende Endpreis. Die gesetzliche Umsatzsteuer (DE: 19 %) ist enthalten und wird auf der Rechnung ausgewiesen; Unterschiede zwischen den nationalen Steuersätzen tragen wir, der angezeigte Preis ändert sich dadurch nicht.
Der Kaufvertrag kommt zustande, wenn Sie Fotoauswahl und Lieferadresse bestätigen, diesen AGB ausdrücklich zustimmen und die Zahlung erfolgreich abgeschlossen ist.
Sie erhalten eine In-App-Bestätigung und zusätzlich eine Bestätigung per E-Mail auf einem dauerhaften Datenträger mit Ihren Bestelldaten und diesen AGB (Art. 8 Abs. 7 der Richtlinie 2011/83/EU, § 312f BGB).
Die Zahlungsabwicklung erfolgt durch Stripe, Inc. und dessen EU-Gesellschaften. Wir speichern keine vollständigen Kartendaten.
Abzüge werden von Familink SAS (Frankreich) produziert und über La Poste und Partnerdienstleister versandt.
Lieferzeiten sind Schätzungen. Die Gefahr geht mit Übergabe an Sie über.
Alle Rechte an Ihren Fotos bleiben bei Ihnen. Sie räumen uns lediglich ein einfaches, weltweites, unentgeltliches Recht ein, die ausgewählten Fotos zu speichern, zu übermitteln, zu vervielfältigen und zu drucken sowie an Druckpartner und Zusteller weiterzugeben — ausschließlich zur Ausführung Ihrer Bestellung. Die Lizenz endet mit der Löschung der Fotos (innerhalb von 30 Tagen nach Bestellung). Keine Nutzung für Werbung oder KI-Training.
Mit der Bestellung bestätigen Sie, dass Sie über die Rechte an den Fotos verfügen, die erforderlichen Einwilligungen abgebildeter Personen vorliegen und keine Rechte Dritter verletzt werden.
Verbotene Inhalte. Nicht zulässig sind rechtswidrige Inhalte, insbesondere Darstellungen sexuellen Kindesmissbrauchs, volksverhetzende Inhalte sowie unzulässige Vervielfältigungen (z. B. Geldscheine, Ausweisdokumente). Verdachtsfälle auf Darstellungen sexuellen Kindesmissbrauchs werden den zuständigen Strafverfolgungsbehörden gemeldet.
Sie stellen uns von Ansprüchen Dritter frei, die aus einem Verstoß gegen diesen Abschnitt entstehen.
Fotoabzüge werden nach Ihren Vorgaben angefertigt. Gemäß § 312g Abs. 2 Nr. 1 BGB i. V. m. Art. 16 Buchst. c der Richtlinie 2011/83/EU besteht kein Widerrufsrecht bei Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl des Verbrauchers maßgeblich ist.
Mit Abschluss der Zahlung bestätigen Sie ausdrücklich, dass Ihre Abzüge nach Ihrer Spezifikation gefertigt werden und Ihnen deshalb kein 14-tägiges Widerrufsrecht zusteht, und verlangen den sofortigen Produktionsbeginn.
Bei einem Irrtum kontaktieren Sie uns bitte sofort. Ist die Produktion noch nicht gestartet, stornieren und erstatten wir kulanzhalber.
Ihre Rechte bei mangelhafter, beschädigter oder falscher Ware bleiben unberührt — siehe Abschnitt 9.
Es gilt die gesetzliche Gewährleistung von zwei Jahren ab Lieferung gemäß §§ 434 ff. BGB und der Richtlinie (EU) 2019/771: Nacherfüllung (Nachdruck), gegebenenfalls Minderung oder Rücktritt.
Unsere Rückgaberichtlinie bittet um Meldung innerhalb von 14 Tagen, damit wir schnell helfen können. Diese 14 Tage sind ein Serviceversprechen, keine Ausschlussfrist. Ihre gesetzlichen Rechte bestehen unabhängig davon für die volle gesetzliche Dauer.
Unsere Haftung ist auf den Bestellwert begrenzt; für mittelbare Schäden haften wir nicht. Unberührt bleibt die Haftung bei Vorsatz und grober Fahrlässigkeit, bei Verletzung wesentlicher Vertragspflichten, bei Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz. Gesetzliche Verbraucherrechte bleiben unberührt.
Bitte wenden Sie sich zuerst an contact@crocodata.net. Wir bestätigen Beschwerden innerhalb von 3 Werktagen.
Führt dies nicht zur Lösung, stehen Verbrauchern zur Verfügung: das Europäische Verbraucherzentrum (ECC-Net) im Wohnsitzland — in Deutschland evz.de — sowie in Polen der Rzecznik Konsumentów und UOKiK.
Wir sind nicht verpflichtet und nicht bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle im Sinne des VSBG teilzunehmen.
Es gilt polnisches Recht. Diese Rechtswahl entzieht Verbrauchern nicht den Schutz zwingender Vorschriften ihres gewöhnlichen Aufenthaltsstaats (Art. 6 Rom-I-VO).
Wesentliche Änderungen werden in der App und per E-Mail mitgeteilt. Für Ihre Bestellung gilt die zum Bestellzeitpunkt gültige Fassung.
Status usługi: FotoPost jest obecnie w fazie rozwoju i nie jest jeszcze powszechnie dostępny. Regulamin dotyczy zamówień składanych po uruchomieniu usługi oraz zamówień testowych.
Regulamin dotyczy wszystkich zamówień składanych w aplikacji FotoPost. Bezwzględnie obowiązujące przepisy o ochronie konsumentów mają zawsze pierwszeństwo przed postanowieniami regulaminu.
Sprzedajemy odbitki 10×15 cm w stałych pakietach. Wszystkie ceny są cenami całkowitymi: zawierają VAT oraz koszt dostawy. Nie doliczamy osobnych kosztów wysyłki ani opłat manipulacyjnych.

Waluta zależy od kraju dostawy. Cena widoczna na ekranie potwierdzenia jest ceną ostateczną. VAT (PL: 23 %) jest zawarty w cenie i wykazany na fakturze.
Umowa zostaje zawarta z chwilą potwierdzenia wyboru zdjęć i adresu dostawy, akceptacji regulaminu oraz skutecznego zaksięgowania płatności.
Otrzymasz potwierdzenie w aplikacji oraz dodatkowo potwierdzenie e-mailem na trwałym nośniku wraz z treścią regulaminu (art. 21 ustawy o prawach konsumenta, art. 8 ust. 7 dyrektywy 2011/83/UE).
Płatności obsługuje Stripe, Inc. i jego spółki w UE. Nie przechowujemy pełnych danych kart.
Odbitki produkuje i wysyła Familink SAS (Francja); doręcza La Poste i przewoźnicy partnerscy.
Zachowujesz wszystkie prawa do swoich zdjęć. Udzielasz nam wyłącznie ograniczonej, niewyłącznej, nieodpłatnej licencji na przechowywanie, przesyłanie, zwielokrotnianie i drukowanie wybranych zdjęć oraz przekazanie ich drukarni i przewoźnikowi — wyłącznie w celu realizacji zamówienia. Licencja wygasa z chwilą usunięcia zdjęć (do 30 dni od złożenia zamówienia). Nie wykorzystujemy zdjęć do marketingu ani do trenowania modeli AI.
Składając zamówienie oświadczasz, że przysługują Ci prawa do zdjęć, posiadasz zgodę osób przedstawionych na zdjęciach (art. 81 ustawy o prawie autorskim i prawach pokrewnych) i nie naruszasz praw osób trzecich.
Treści zabronione. Nie wolno przesyłać materiałów niezgodnych z prawem, w szczególności materiałów przedstawiających seksualne wykorzystywanie dzieci, treści nawołujących do przemocy, ani reprodukcji zabronionych (np. banknotów, dokumentów tożsamości). Podejrzenie materiałów CSAM zgłaszamy organom ścigania.
Odbitki są wykonywane według Twojej specyfikacji. Zgodnie z art. 38 pkt 3 ustawy z dnia 30 maja 2014 r. o prawach konsumenta (art. 16 lit. c dyrektywy 2011/83/UE) prawo odstąpienia nie przysługuje.
Dokonując płatności wyraźnie potwierdzasz, że odbitki są wykonywane według Twojej specyfikacji i że w związku z tym nie przysługuje Ci 14-dniowe prawo odstąpienia, oraz żądasz niezwłocznego rozpoczęcia produkcji.
W razie pomyłki skontaktuj się natychmiast — jeśli produkcja jeszcze się nie rozpoczęła, anulujemy i zwrócimy płatność w ramach dobrej woli.
Powyższe nie ogranicza Twoich praw w razie wady, uszkodzenia lub niezgodności towaru — patrz punkt 9.
Przysługuje Ci ustawowa odpowiedzialność sprzedawcy za zgodność towaru z umową przez 2 lata od dostawy (ustawa o prawach konsumenta, dyrektywa (UE) 2019/771): naprawa lub wymiana (ponowny wydruk), a następnie obniżenie ceny lub odstąpienie od umowy.
W Polityce zwrotów prosimy o zgłoszenie w ciągu 14 dni, aby przyspieszyć obsługę. Te 14 dni to zobowiązanie serwisowe, a nie termin zawity. Twoje uprawnienia ustawowe obowiązują przez pełen okres ustawowy.
Nasza odpowiedzialność jest ograniczona do wartości zamówienia i nie obejmuje szkód pośrednich. Ograniczenie nie dotyczy winy umyślnej, rażącego niedbalstwa, szkód na osobie ani odpowiedzialności za produkt niebezpieczny. Ustawowe prawa konsumenta pozostają nienaruszone.
Prosimy najpierw o kontakt: contact@crocodata.net. Potwierdzamy reklamację w ciągu 3 dni roboczych i rozpatrujemy ją w terminie 14 dni.
Jeśli spór nie zostanie rozwiązany, konsument może skorzystać z pomocy Powiatowego (Miejskiego) Rzecznika Konsumentów, Wojewódzkiego Inspektoratu Inspekcji Handlowej (mediacja i stały polubowny sąd konsumencki), UOKiK — uokik.gov.pl, a w sprawach transgranicznych z Europejskiego Centrum Konsumenckiego — konsument.gov.pl.
Stosuje się prawo polskie, co nie pozbawia konsumenta ochrony wynikającej z bezwzględnie obowiązujących przepisów państwa jego zwykłego pobytu (art. 6 rozporządzenia Rzym I).
O istotnych zmianach poinformujemy w aplikacji i e-mailem. Do zamówienia stosuje się wersję obowiązującą w chwili jego złożenia.

Les présentes CGV régissent toutes les commandes passées via l'application FotoPost. Les dispositions impératives du droit de la consommation français priment sur toute clause contraire.
Nous vendons des tirages 10×15 cm en lots fixes. Tous les prix sont des prix totaux : TVA incluse et livraison incluse. Aucun frais de port ni frais de dossier n'est ajouté.

La devise dépend de votre pays de livraison. Le prix affiché avant paiement est le prix payé. La TVA (FR : 20 %) est comprise et figure sur la facture.
Le contrat est conclu lorsque vous confirmez votre sélection et votre adresse, acceptez les CGV et que le paiement aboutit.
Vous recevez une confirmation dans l'application et, en outre, une confirmation par e-mail sur support durable reprenant votre commande et les présentes CGV (art. 8, §7 de la directive 2011/83/UE ; art. L. 221-13 du Code de la consommation).
Les paiements sont traités par Stripe, Inc. et ses entités européennes. Nous ne conservons pas vos données de carte.
Les tirages sont produits et expédiés par Familink SAS (France), acheminés par La Poste et ses partenaires.
Vous conservez tous vos droits sur vos photos. Vous nous accordez uniquement une licence limitée, non exclusive, mondiale et gratuite pour stocker, transmettre, reproduire et imprimer les photos sélectionnées et les transmettre à notre imprimeur et au transporteur, aux seules fins d'exécuter votre commande. Elle prend fin à la suppression des photos (sous 30 jours). Aucun usage marketing ni entraînement de modèles d'IA.
En commandant, vous garantissez détenir les droits sur les photos, disposer du consentement des personnes identifiables représentées (droit à l'image) et ne violer aucun droit de tiers.
Contenus interdits. Sont proscrits les contenus illicites, notamment les contenus pédopornographiques, l'incitation à la haine ou à la violence et les reproductions interdites (billets de banque, documents d'identité). Tout soupçon de contenu pédopornographique est signalé aux autorités compétentes.
Les tirages sont confectionnés selon vos spécifications. Conformément à l'article L. 221-28 3° du Code de la consommation (art. 16 c) de la directive 2011/83/UE), le droit de rétractation de 14 jours ne s'applique pas.
En finalisant le paiement, vous reconnaissez expressément que vos tirages sont confectionnés selon vos spécifications et que vous ne bénéficiez donc pas du droit de rétractation de 14 jours, et vous demandez le démarrage immédiat de la production.
En cas d'erreur, contactez-nous immédiatement : si la production n'a pas commencé, nous annulons et remboursons à titre commercial.
Vos droits en cas de produit défectueux, endommagé ou non conforme demeurent — voir section 9.
Vous bénéficiez de la garantie légale de conformité (2 ans) des articles L. 217-3 et suivants du Code de la consommation et de la garantie des vices cachés (art. 1641 et s. du Code civil).
Notre Politique de remboursement vous invite à signaler tout problème sous 14 jours pour un traitement rapide. Ce délai de 14 jours est un engagement de service, non un délai de forclusion. Vos garanties légales s'appliquent pendant toute leur durée légale.
Notre responsabilité est limitée à la valeur de la commande et exclut les dommages indirects. Cette limitation ne s'applique pas en cas de faute intentionnelle ou lourde, d'atteinte aux personnes, ni en matière de responsabilité du fait des produits défectueux. Vos droits légaux demeurent inchangés.

Conformément aux articles L. 612-1 et suivants du Code de la consommation, tout consommateur a le droit de recourir gratuitement à un médiateur de la consommation. Médiateur compétent : à désigner avant l'ouverture des ventes en France — les coordonnées complètes (nom, adresse, site) seront publiées ici et communiquées sur demande à contact@crocodata.net.
Vous pouvez également saisir le Centre Européen des Consommateurs France — europe-consommateurs.eu.
Les présentes CGV sont soumises au droit polonais, sans priver le consommateur de la protection des dispositions impératives du droit de sa résidence habituelle (art. 6 du règlement Rome I).
Les modifications importantes sont notifiées dans l'application et par e-mail. La version applicable est celle en vigueur au moment de la commande.
