These terms govern all orders placed through the FotoPost mobile application. By placing an order, you agree to these terms. Where your country of residence grants you stronger consumer rights under mandatory local law, those rights are not affected.
FotoPost offers physical photo prints. All prices are final and include applicable VAT for your country:
VAT is calculated automatically based on your country at checkout. Prices displayed in the app are inclusive of VAT.
The contract is concluded when you confirm your photo selection, delivery address, and payment is completed. You will receive an in-app confirmation.
Payments are processed by Stripe, Inc. We accept major credit and debit cards. We do not store your payment details.
Prints are produced and shipped by Familink SAS (France). Estimated delivery: 5–10 business days within the EU. Delivery times are estimates and may vary.
Photo prints are personalised goods made to your specification. Under Article 16(c) of EU Directive 2011/83/EU, the 14-day right of withdrawal does not apply to goods made to consumer specifications or clearly personalised. Once your order is confirmed and payment completed, it cannot be cancelled.
Please check your photo selection and delivery address carefully before confirming.
You benefit from a 2-year statutory warranty on the physical goods under EU law (Directive 2019/771). If the prints are defective or do not conform to the order, contact us within 2 years of delivery. See our Refund Policy for how to proceed.
Our liability is limited to the value of the order. We are not liable for indirect damages. Nothing in these terms limits your statutory consumer rights.
These terms are governed by Polish law. EU consumers retain the benefit of mandatory consumer protection laws of their country of residence. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
We may update these terms. We will notify you of material changes via in-app notice.
Diese AGB gelten für alle Bestellungen über die FotoPost-App. Mit der Bestellung stimmen Sie diesen Bedingungen zu. Zwingende Verbraucherschutzvorschriften Ihres Wohnsitzlandes bleiben unberührt — insbesondere das deutsche Verbraucherrecht (BGB).
Alle Preise sind Endpreise inkl. der jeweils gültigen gesetzlichen Umsatzsteuer (DE: 19 %):
Die Mehrwertsteuer wird beim Checkout automatisch anhand Ihres Landes berechnet.
Der Kaufvertrag kommt mit erfolgreicher Zahlung zustande. Sie erhalten eine In-App-Bestätigung.
Die Zahlungsabwicklung erfolgt durch Stripe, Inc. Wir akzeptieren gängige Kredit- und Debitkarten. Wir speichern keine Zahlungsdaten.
Abzüge werden von Familink SAS (Frankreich) produziert und versandt. Geschätzte Lieferzeit: 5–10 Werktage innerhalb der EU.
Fotoabzüge sind nach Ihren Vorgaben personalisierte Waren. Gemäß § 312g Abs. 2 Nr. 1 BGB in Verbindung mit Art. 16 Buchst. c der Richtlinie 2011/83/EU besteht kein Widerrufsrecht bei Waren, die nach Kundenspezifikation angefertigt werden. Nach Bestellbestätigung und Zahlungseingang ist eine Stornierung nicht möglich.
Bitte prüfen Sie Fotoauswahl und Lieferadresse sorgfältig vor Bestellabschluss.
Es gilt die gesetzliche Gewährleistung von 2 Jahren gemäß §§ 434 ff. BGB. Bei mangelhaften oder nicht vertragskonformen Abzügen wenden Sie sich bitte innerhalb von 2 Jahren nach Lieferung an uns. Einzelheiten finden Sie in unserer Rückgaberichtlinie.
Unsere Haftung ist auf den Bestellwert begrenzt, außer bei Vorsatz, grober Fahrlässigkeit oder der Verletzung wesentlicher Vertragspflichten. Ansprüche aus dem Produkthaftungsgesetz bleiben unberührt.
Es gilt polnisches Recht; zwingende deutsche Verbraucherschutzvorschriften bleiben anwendbar. EU-Plattform zur Online-Streitbeilegung: ec.europa.eu/consumers/odr. Wir sind nicht verpflichtet und nicht bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
Wesentliche Änderungen werden per In-App-Benachrichtigung mitgeteilt.
Niniejszy regulamin dotyczy wszystkich zamówień składanych za pośrednictwem aplikacji FotoPost. Składając zamówienie, akceptujesz jego postanowienia. Bezwzględnie obowiązujące przepisy o ochronie konsumentów pozostają w mocy.
Wszystkie ceny są cenami brutto zawierającymi VAT (PL: 23 %):
Podatek VAT naliczany jest automatycznie podczas płatności na podstawie kraju dostawy.
Umowa zostaje zawarta z chwilą pomyślnego zaksięgowania płatności. Otrzymasz potwierdzenie w aplikacji.
Płatności obsługuje Stripe, Inc. Akceptujemy główne karty kredytowe i debetowe. Nie przechowujemy danych płatniczych.
Odbitki produkuje i wysyła Familink SAS (Francja). Szacowany czas dostawy: 5–10 dni roboczych w obrębie UE.
Odbitki fotograficzne są towarami wyprodukowanymi według Twoich specyfikacji. Na podstawie art. 38 pkt 3 ustawy z dnia 30 maja 2014 r. o prawach konsumenta (implementującej art. 16 lit. c Dyrektywy 2011/83/UE) prawo odstąpienia od umowy nie przysługuje w przypadku towarów nieprefabrykowanych, wyprodukowanych według specyfikacji konsumenta. Po potwierdzeniu zamówienia i zaksięgowaniu płatności rezygnacja nie jest możliwa.
Prosimy o dokładne sprawdzenie wyboru zdjęć i adresu dostawy przed złożeniem zamówienia.
Przysługuje Ci 2-letnia rękojmia na zakupiony towar zgodnie z przepisami Kodeksu cywilnego oraz ustawy o prawach konsumenta. W przypadku wad lub niezgodności towaru z umową skontaktuj się z nami w ciągu 2 lat od dostawy. Szczegóły znajdziesz w naszej Polityce zwrotów.
Nasza odpowiedzialność ograniczona jest do wartości zamówienia. Nie ponosimy odpowiedzialności za szkody pośrednie. Ustawowe prawa konsumenta pozostają nienaruszone.
Stosuje się prawo polskie. Konsument może skierować spór do Stałego Polubownego Sądu Konsumenckiego lub skorzystać z platformy ODR Komisji Europejskiej: ec.europa.eu/consumers/odr. Konsument może również zwrócić się do Rzecznika Finansowego lub Urzędu Ochrony Konkurencji i Konsumentów (UOKiK).
O istotnych zmianach poinformujemy Cię powiadomieniem w aplikacji.
Les présentes CGV régissent toutes les commandes passées via l'application FotoPost. En passant une commande, vous acceptez ces conditions. Les dispositions impératives du droit de la consommation français vous restent applicables.
Tous les prix sont TTC (TVA française : 20 %) :
La TVA est calculée automatiquement selon votre pays lors du paiement.
Le contrat est conclu dès la confirmation du paiement. Vous recevrez une confirmation dans l'application.
Les paiements sont traités par Stripe, Inc. Nous acceptons les principales cartes bancaires. Nous ne conservons pas vos données de paiement.
Les tirages sont produits et expédiés par Familink SAS (France). Délai estimé : 5–10 jours ouvrés au sein de l'UE.
Les tirages photo sont des biens confectionnés selon vos spécifications. Conformément à l'article L. 221-28 3° du Code de la consommation (transposant l'art. 16 c) de la Directive 2011/83/UE), le droit de rétractation de 14 jours ne s'applique pas aux biens confectionnés selon les spécifications du consommateur ou nettement personnalisés. Une fois la commande confirmée et le paiement effectué, l'annulation n'est pas possible.
Veuillez vérifier attentivement votre sélection de photos et votre adresse de livraison avant de confirmer.
Vous bénéficiez de la garantie légale de conformité de 2 ans prévue aux articles L. 217-3 et suivants du Code de la consommation, ainsi que de la garantie contre les vices cachés (art. 1641 et s. du Code civil). En cas de défaut ou de non-conformité, contactez-nous dans les 2 ans suivant la livraison. Voir notre Politique de remboursement.
Conformément aux articles L. 612-1 et suivants du Code de la consommation, vous avez le droit de recourir gratuitement à un médiateur de la consommation en cas de litige non résolu. Nous vous communiquerons les coordonnées du médiateur compétent sur simple demande à fotopostprint@gmail.com. Plateforme ODR : ec.europa.eu/consumers/odr.
Notre responsabilité est limitée à la valeur de la commande. Nous ne sommes pas responsables des dommages indirects. Vos droits légaux en tant que consommateur demeurent inchangés.
Les présentes CGV sont soumises au droit polonais, sans préjudice des dispositions impératives du droit français de la consommation applicables aux consommateurs résidant en France.
Tout changement important sera notifié par une notification dans l'application.
